I talked to the guy in charge of my car a week ago about my car and he says it may be a “total loss”. Just wondering if they can towed my car to the junk yard without notifying me.
Can auto shops tow away your car if its been declared a “total loss” without notifying you?

No. Until you settle with the insurance company you still own the car.

legally they are not supposed to do anything when in possesion of your car except the authorized repairs…and unless your insurance adjuster was contacted and determined it a total loss…then the shop guys word is considered an opinion at this point not a proven fact….if they say they cannot repair then they can charge you for a whole bunch of storage from the time they told you this…and if you refuse to pay storage then if there are no leins on car…they can keep or sell the car as a totl for unpaid storage fees…but if they do business legit…there is a process involved where you are given ample opportunity to settle with them…unfortunately after they “say” it is total loss..alot of them hope you will not want to pay storage or tow fee and hope you will just sign it over to them and by then they probably have buyers for any parts they can canibalize….

If thy remover your car with out telling you call the police and have them arrested. Thy can not take your car with out telling you. If he thinks it is a total loss, only you can make that dissuasion. It might be a total loss to him, but ma-by you want to sell it as is, donate it to some one or ma by part it out. He cant do that with out your written OK.

They can tow it. They usually tell you after the fact so you will have to pay their ridiculous rates. Gary’s Towing in Tucson Az always pulls this kind of crap!

Did you file a claim against your collision coverage? If so, do you know if you gave the claims rep “permission to tow”, if the vehicle was declared a total loss?
If you did, it is possible the insurance company had the vehicle pulled and towed to their salvage yard to avoid ongoing storage charges.
Otherwise, the auto body should not have had your vehicle towed without your permission.
